PUMA AdvoCAT Loyalty Program

General Terms and Conditions

The following Terms and Conditions (“Terms”) shall govern your participation in the AdvoCAT Customer Loyalty Program (“AdvoCAT Program”). By registering to the AdvoCAT Program, it shall be construed that you have read, understood, and agreed, without limitation or qualification, to be bound by these Terms.

In relation to your use of the PUMA Malaysia Online Store accessible at (my.puma.com) (“PUMA.COM”), the PUMA.COM’s Terms of Use, Terms of Purchase and Privacy Policy shall apply in addition to these Terms.

1. The AdvoCAT Customer Loyalty Program

1.1. The AdvoCAT Program is owned (but not operated) by [PUMA Sports Good Sdn Bhd] (“PUMA”) having its registered office address at PUMA Sports Goods Sdn Bhd (Reg No. 200701008334 (766336-V)) Menara Mustapha Kamal, Block A, Level 10, PJ Trade Centre, No.8, Jalan PJU 8/8A, Bandar Damansara Perdana,Petaling Jaya, 47820 Selangor Malaysia. The AdvoCAT Program is managed by a third-party service provider engaged by PUMA or a related company (“Service Provider”). PUMA shall not be liable towards customers for any act or omission committed by the Service Provider.

1.2. The AdvoCAT Program is a multi-tier rewards program available to eligible PUMA customers in Malaysia, designed to reward continued engagement with PUMA and purchases of PUMA Products. Members of the AdvoCAT Program will earn loyalty points (“Points”) for every eligible purchase of PUMA Products through PUMA.COM or at participating PUMA retail stores in [Malaysia] (“PUMA Stores”). 1.3. The AdvoCAT Program offers four (4) membership tier status – Club, Plus, Pro, and Elite – with each higher tier providing increased Point multipliers. Plus-tier members earn one (1) Point for every [MYR 1.00] spent on eligible PUMA purchases. Tier upgrades are based on a members’ total annual spend as outlined in the table below:

1.4. Earned Points may be redeemed via the AdvoCAT Page on PUMA.COM by converting Points into discount vouchers which a member may use in future PUMA product purchases on PUMA.COM and in PUMA Stores. The Points to discount voucher conversion is as follows:

2. Qualification

Only PUMA customers who are at least eighteen (18) years of age are eligible to participate in the AdvoCAT Program.

3. AdvoCAT Membership Registration

3.1. PUMA customers may register as an AdvoCAT member through the following channels:

• by creating an account at any participating PUMA Store; or
• by creating an account on PUMA.COM.

3.2. Customers who have an existing PUMA.COM account have been automatically enrolled as an AdvoCAT member. Likewise, customers who create a new account on PUMA.COM will automatically become AdvoCAT members upon successful registration. No additional action is required to join the AdvoCAT Program. Membership is free of charge and no purchase is required for such registration.

3.3. A customer may become an AdvoCAT member by registering and providing the following information:

• Name
• E-mail Address
• Mobile Number
• Gender
• Birthdate

PUMA reserves the right, at its sole discretion, to request additional information or documents to verify the customer’s identity or eligibility for the AdvoCAT Program. PUMA further reserves the right to approve, deny, or revoke participation in the AdvoCAT Program by any individual for any reason whatsoever with immediate effect, with prior reasonable notice.

3.4. The membership to the AdvoCAT Program will remain active and available as long as the member’s PUMA.COM account is active or until PUMA’s cancellation of the AdvoCAT Program.

3.5. AdvoCAT members will be automatically upgraded to the next membership tier based on their total eligible spend within a calendar year. Once upgraded, the member’s tier status will remain valid until the end of the following calendar year. If a member does not meet the minimum spend requirement for the current tier during the subsequent calendar year, their tier status will be adjusted accordingly at the start of the next calendar year based on their actual spend.

4. Earning of Points

4.1. AdvoCAT members are entitled to earn Points for every purchase of eligible PUMA products, whether full-priced or discounted. Points will be awarded based on the net amount actually paid as reflected in the official receipt or invoice, excluding any applicable taxes (e.g., GST or VAT), delivery charges and other fees (if any).

       Points may be earned through the following methods for both cash and credit transactions:

1. In-store purchases: To earn Points, the AdvoCAT member must provide their registered mobile number to the PUMA retail staff at the time of checkout. The Points will be credited automatically to their AdvoCAT account associated with the mobile number provided.
2. Online purchases: To earn Points, the AdvoCAT member must be logged in to their PUMA.COM account when completing the online checkout process. Points will be credited upon successful payment and confirmation of the transaction.

4.2. PUMA reserves the right to deduct accumulated Points, refuse the conversion of any Points, or recall accumulated Points under the following circumstances:

• Points derived from a successful transaction which has been cancelled, refunded, or reversed for any reason;
• Points earned from a suspected fraudulent or unlawful transaction; or
• Points erroneously earned due to a technical system error.

4.3. Points are non-transferable and non-assignable.

5. Validity and Expiry of Points

AdvoCAT Points are valid for a period of twelve (12) months from the date they are earned. Any unused Points will automatically expire at the end of its validity period and will be forfeited without prior notice. Expired Points cannot be reinstated or redeemed.

6. Conversion of Points and Use of AdvoCAT Vouchers

6.1. Members who accumulated sufficient Points may convert them for AdvoCAT discount vouchers (“AdvoCAT Vouchers”) through their registered account on PUMA.COM under the AdvoCAT Page. To do so, members must log-in to their registered account and convert their available Points into AdvoCAT Vouchers. Upon successful conversion, a unique voucher code will be generated and made available to the member on the AdvoCAT Page for use in future online and in-store purchases.

6.2. AdvoCAT Vouchers may only be redeemed in participating PUMA Stores and PUMA.COM:

1. In-store purchases: To use the AdvoCAT Vouchers, members are required to present the valid voucher code to the PUMA retail staff at the time of checkout. The voucher code will be entered into the system and the corresponding AdvoCAT Voucher amount will be automatically deducted from the total amount of the eligible transaction. If a refund is processed for a transaction where an AdvoCAT Voucher was applied, the Points used to convert and redeem the AdvoCAT Voucher will not be reinstated to the member’s account under any circumstances. Once an AdvoCAT Voucher has been used, it will not be reinstated under any circumstances. However, in exceptional cases such as returns or refunds due to defective products, an equivalent discount voucher to the one used in the transaction may be issued to the member on a case-to-case basis, subject to PUMA’s review and approval.
2. Online purchases: To use the AdvoCAT Vouchers, members must enter the unique voucher code in the designated field at checkout while logged-in to their registered PUMA.COM account. Upon successful validation, the corresponding AdvoCAT Voucher amount will be automatically deducted from the total amount of the eligible transaction. If a refund is issued for an online purchase in which an AdvoCAT Voucher was applied, the Points used to generate the AdvoCAT Voucher will not be reinstated to the member’s account under any circumstances. Once an AdvoCAT Voucher has been used, it will not be reinstated under any circumstances. However, in exceptional cases such as returns or refunds due to defective or incorrectly delivered products, an equivalent discount voucher to the one used in the transaction may be issued to the member on a case-to-case basis, subject to PUMA’s review and approval.

6.3. AdvoCAT Vouchers are valid for a period of three (3) months after they have been converted from AdvoCAT Points. Any unused AdvoCAT Voucher will automatically expire at the end of its validity period and will be forfeited without prior notice.

6.4. AdvoCAT Vouchers may be combined with other PUMA.COM and in-store promotions, subject to applicable terms and exclusions. Only one (1) AdvoCAT Voucher is allowed per transaction. Points and AdvoCAT Vouchers are non-redeemable for cash and hold no cash value.

7. Other Benefits

PUMA may, from time to time and at its sole discretion, offer added discounts and benefits granted under the AdvoCAT Program. PUMA will endeavor to provide AdvoCAT members with accurate and timely information regarding any additional benefits under the AdvoCAT Program, however, PUMA shall not be liable in any way for failure to do so.

8. AdvoCAT Program Privacy Policy

8.1. By joining the AdvoCAT Program, you are deemed to have accepted and is bound by these Terms and the Privacy Policy (available at https://my.puma.com/my/en/privacy-policy/PRIVACY_POLICY.html). By becoming an AdvoCAT member, you:

• consent to receiving communications at your mobile number and/or email address from time to time;
• authorize PUMA to share your information to the Service Provider and/or authorized contractors of PUMA and PUMA’s related companies for the purpose/s specified in this Clause 8;
• authorize PUMA and Service Provider to transfer your information outside of Malaysia for the purposes specified in this Clause 8; and
• confirm and acknowledge that you have become an AdvoCAT member by your own will and without any undue influence from PUMA.

8.2. PUMA and Service Provider shall maintain and use AdvoCAT members’ personal information for purposes of market research and statistical analysis, customer relationship management, after-sale services, administrative and accounting purposes and also to send communications including electronic communications containing news, information and updates, or otherwise, about its Products (including apparel, shoes, accessories), services, offers, promotions, online purchases, special events, and other marketing communications that may be of interest to the customer. For avoidance of doubt, members shall have the option to opt out of receiving advertising or promotional information via his mobile number and/or email address.

8.3. Members’ personal information will be stored for a period necessary and proportionate to the purposes described above in compliance with applicable laws of Malaysia. The customer acknowledges he / she may access, update, correct or delete their information or object to the processing of their information for marketing purposes by writing to [email protected]. Members acknowledge that PUMA cannot delete personal information without restricting or removing a member’s participation in the AdvoCAT Program and that PUMA may not accommodate such request to correct and/or delete personal data if PUMA believes that it will be in violation of a legal requirement or obligation.

8.4. PUMA acknowledges that it will comply with applicable personal data protection laws when collecting and managing members’ personal data.

9. Modification or Termination of the AdvoCAT Program

9.1. PUMA reserves the right to add, alter, amend and revise these Terms at any time with reasonable notice and at its sole and absolute discretion.

9.2. PUMA has the right to monitor all AdvoCAT Program activity. If, at PUMA’s sole discretion, it is found that the AdvoCAT member is engaging or has engaged in any fraudulent, unlawful or suspicious activity, misrepresentation, and/or abuse of the AdvoCAT Program, PUMA reserves the right to suspend or terminate the AdvoCAT membership and withdraw any of its benefits, prohibit the member from earning Points, and/or forfeit all Points earned, without prejudice to any other legal remedy that PUMA may have under applicable law.

9.3. PUMA reserves the right to modify, suspend, or terminate the AdvoCAT Program, in whole or in part, at any time for any reason with reasonable prior notice. In the event of termination of the AdvoCAT Program, any unused Points or AdvoCAT Vouchers will be forfeited and shall not be redeemable for cash or credit.

10. Intellectual Property

The name “AdvoCAT” and all information, material and content related to the AdvoCAT Program, existing and in the future, are owned by PUMA SE and/or its related companies and protected by applicable intellectual property laws. Participation in the AdvoCAT Program does not grant any rights to use PUMA’s intellectual property without its prior written consent.

11. Limitation of Liability

PUMA shall not be liable to any AdvoCAT members or his / her nominee, for any indirect, special or consequential loss (of any manner whatsoever), damage or expense of any kind whatsoever, arising out of or in connection with the AdvoCAT Program and/or the provision or the refusal to provide any program benefits.  To the fullest extent permitted by law, PUMA’s liability towards any customer for any misconduct or negligence in relation to the AdvoCAT Program shall be limited to the value of the Points earned by the customer in the twelve (12) consecutive months preceding such misconduct or negligence.

12. Force Majeure

PUMA shall not be liable for any delay, interruption, or failure to operate the AdvoCAT Program including the accrual or conversion of Points or redemption of AdvoCAT Vouchers, due to events beyond its reasonable control, such as natural disasters, epidemic/pandemic, government restrictions, system outages, breakdown in computers and communication facilities, computer-related errors, and other force majeure events. In such cases, PUMA reserves the right to suspend or modify the AdvoCAT Program as necessary without prior notice.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia. Any dispute arising out of these Terms shall be subject to the sole jurisdiction of the courts of Malaysia.
